George Mason Law Review is excited to share that Supreme Court Justice Clarence Thomas cited The Jurisprudence of the Second and Fourteenth Amendments in his dissent from the denial of certiorari in Rogers v. Grewal. This article appeared in Volume 4, Issue 1 of the George Mason University Law Review – published back in the Spring of 1981!

Rogers v. Grewal was decided on June 15, 2020. Justice Brett Kavanaugh joined Justice Thomas’ dissent, except for Part II of the dissent. The case concerned whether the Second Amendment protects the right to carry a firearm outside the home for self-defense, and whether the government may deny the exercise of this right to law-abiding citizens by conditioning its exercise on a showing of a special need to carry a firearm.
