GMLR Cited by Ninth Circuit in FTC v. Qualcomm Inc.

George Mason Law Review is pleased to share that our article, SSOs, FRAND, and Antitrust: Lessons from the Economics of Incomplete Contracts, written by Professor Joshua Wright of George Mason University Antonin Scalia Law School, has been cited by the Ninth Circuit Court of Appeals in its recent opinion in FTC v. Qualcomm Inc.

The article examines whether antitrust laws should govern the standards development process between standards development organizations and their member firms. The decision cites Professor Wright’s article on three occasions as support for the proposition that the antitrust laws should not be used to enforce the agreements made during this process when contract and patent law will do.
